Top Trust and Estate Issues the Texas Supreme Court Should Address

Trust and estate litigation is increasing due to the aging of our population and the great transfer of wealth over the next twenty years. This presentation will address the top issues that the Texas Supreme Court should address that will assist parties in litigating trust and estate cases: jury trial rights in trust disputes, personal jurisdiction over trustees and beneficiaries, the payment of attorney’s fees before the termination of litigation, litigating self-interested transactions, no-contest clauses, exculpatory clauses, and aiding and abetting breach of fiduciary duty claims.
