This presentation will address fiduciary issues that Texas courts resolved during the review period of summer of 2024 to summer of 2025. The presentation will review the following issues: whether a party has a right to jury trial in trust proceedings, what standards apply to the determination of whether a Texas court has personal jurisdiction over a trust beneficiary, whether there are fiduciary duties that arise from confidential relationships, a settlor’s duty to fund assets into a trust, a contingent beneficiary’s standing to sue a trustee, the rights of wards in guardianship proceedings to sign wills and trusts, the enforceability of choice-of-law clauses in trust documents, the burden of proof for breach of fiduciary duty claims against a trustee, arbitration rights in will disputes, and an estate beneficiary’s right to bring claims on behalf of the estate.
