Tobin Swope is a member of Winstead's Real Estate Development & Investments Practice Group. Tobin’s areas of practice encompass a wide range of commercial real estate transactions involving financing, development, leasing, acquisition and disposition of real property of all asset classes, including multi-family and student housing, office, retail, industrial, flex, healthcare, gas station/convenience store and master planned single-family and mixed-use developments.

Representative Experience

Development, Acquisition and Disposition: Purchase and sale contract drafting and negotiation; due diligence, including zoning, property condition, environmental, title, survey and lease review; and closing matters

  • Representation of a developer in the negotiation, due diligence and closing of land to be developed for student housing projects in various states, including Texas, Oklahoma, Missouri, Georgia, Alabama, North Carolina, Colorado, Virginia, Tennessee and Mississippi
  • Representation of a developer in the development of multiple senior care and specialty hospital facilities in Texas
  • Representation of an international hotel and resort company in the acquisition of multiple hotels and resorts in various states, including Florida, North Carolina, Texas and California
  • Representation of an owner/operator in the acquisition of multiple office and industrial buildings in Texas
  • Representation of client in multiple acquisitions and dispositions of multi-family projects in Texas
  • Representation of an investor/operator in the acquisition and disposition of multiple retail, office and industrial projects in various states
  • Representation of an investor in the acquisition of gas station/convenience stores in Texas

Asset Management and Leasing: Lease and sublease negotiation, extensions and amendments on behalf of landlords/developers and tenants

  • Representation of landlords in leasing and asset management of multiple office buildings in Texas
  • Representation of landlords in leasing and asset management of industrial properties in Texas, Utah and Oklahoma
  • Representation of tenants in multiple long-term ground leases
  • Representation of retail tenants for leases of in-line space and pad sites

Financing: Loan origination and investment due diligence, drafting and negotiation; workouts, foreclosure and disposition of foreclosed upon properties

  • Representation of a lender in the financing of multiple multi-family developments in various states
  • Representation of a lender in the financing of acquisitions of office buildings in Texas
  • Representation of lenders in connection with the restructuring of multiple troubled loans, foreclosing and disposition of real property, including mineral rights
