Jason Enright has significant experience in corporate restructuring and bankruptcy matters, focusing on maximum recovery and results for his clients, which are primarily lenders and commercial landlords in bankruptcy cases and bankruptcy-related litigation throughout the United States. He also has significant experience representing secured and unsecured creditors, debtors, trustees, unsecured creditors’ committees, and buyers of distressed assets in bankruptcy matters.

Prior to entering private practice, Jason served as the judicial law clerk for Chief U.S. Bankruptcy Judge Ronald B. King in the United States Bankruptcy Court for the Western District of Texas. Before clerking for Judge King, Jason served as a judicial law clerk for U.S. Magistrate Judge E. Scott Frost in the United States District Court for the Northern District of Texas.

During law school, Jason was a founding member of the Business & Bankruptcy Law Journal. Before law school, Jason worked in the music industry as a musician and music store owner in Austin, Texas.

Representative Experience

Lender Representation

  • Represented large regional bank as DIP Lender and pre-petition secured lender in the Chapter 11 cases of Nitro Fluids, LLC, et al. (Case No. 24-60018, S.D. Tex.), oil and gas fracking services companies. Successfully negotiated confirmed Chapter 11 plan.
  • Represented large regional bank, secured lender to debtor parent, in the Chapter 7 case of Cinch Wireline Services, LLC, and related adversary proceeding (Case No. 23-51742, Adv. No. 24-05011, W.D. Tex.).  Successfully obtained dismissal of the bankruptcy case and adversary proceeding.
  • Represented large regional bank as secured lender in the Chapter 11 case of Navarro Pecan Company, Inc., (Case No. 23-40266, N.D. Tex.), a Texas pecan business. Successfully negotiated confirmed plan and obtained payment on client’s secured claim in full.
  • Represented large regional bank as secured lender in the Chapter 11 case of Advantage Sports, Inc., (Case No. 20-40666, E.D. Tex.) (converted to Chapter 7), which was a single asset real estate case of a sports complex. Successfully obtained payment on client’s secured claim in full.
  • Represented large national bank as secured lender in the Chapter 7 case of Fieldpoint Petroleum Corporation, (Case No. 20-10726, W.D. Tex.), an oil and gas company. Successfully negotiated with the trustee and obtained significant recovery on secured claim.
  • Represented large regional bank to preserve and enforce rights and claims as lessor in Chapter 9 case of Jack County Hospital District d/b/a Faith Community Health System, (Case No. 20-42012, N.D. Tex.). Successfully negotiated assumption and cure of leases under Chapter 9 plan of adjustment.
  • Represented large regional bank as secured lender in the Chapter 11 cases of Remarkable Healthcare of Carrollton, LP, et al. (Case No. 18-40295, E.D. Tex.), skilled nursing facilities and affiliated companies. Successfully negotiated confirmed Chapter 11 plan.

Commercial Landlord Representation

Represented numerous commercial landlords, real estate investment companies, REITs, and other lessors (private and public) in connection with assumption, assignment, and/or rejection of leases, sales, plan confirmation, and recovery on pre-petition, administrative, and cure claims in the following cases:

Trustee Representation

  • Represented trustee in the Chapter 11 case of Acis Capital Management, L.P., et al. (Case No. 18-30264, N.D. Tex.) a CLO portfolio manager for Highland Capital Management, L.P. Advised trustee regarding administration of the estate, plan formulation and confirmation, and in various adversary proceedings.
  • Represented trustee in the Chapter 7 case of Caroline D. Wyly, (Case No. 14-35074, N.D. Tex.) one of the largest individual Chapter 7 cases in U.S. history. Advised trustee regarding administration and liquidation of the estate and assisted in negotiating settlement with IRS on claim of over $1 billion.

Other Creditor Representation

  • Represented refrigerated storage business in the Chapter 11 case of O'Connor Construction Group, LLC (Case No. 22-40187, Adv. No. 22-04009, N.D. Tex.) (converted to Chapter 7) and related adversary proceeding.  Advised client regarding dissolution of garnishment, sale of debtor’s assets and settlement for recovery of claims. 
  • Represented real estate investment firm as purchaser of residential real estate properties in the Chapter 11 case of Tyndall Parkway Apartments, LLC (Case No. 21-50044, N.D. Fla).
  • Represented minority bondholders in the Chapter 11 case of Washington Prime Group Inc., et al. (Case No. 21-31948, S.D. Tex.), a major owner and developer of retail real estate properties across the U.S.  Successfully negotiated participation in post-confirmation rights offering and release of restrictive rights on equity under the plan.
  • Represented regional financial services company as anchor tenant in Chapter 11, single asset real estate case of WC 717 N Harwood Property, LLC (World Class) (Case No. 21-10630, W.D. Tex.) (converted to Chapter 7). Advised regarding lease issues and successfully obtained payment of claim for TI allowance in full. 
  • Represented a California municipality in the chapter 11 case of California Resources Corporation, et al. (Case No. 20-33568, S.D. Tex.), a publicly traded oil and gas E&P company, the largest oil and gas producer in California at the time.  Advised regarding governmental contracts, lease assumption, cure of claims, and plan confirmation.
  • Represented large regional dairy cooperative, in the Chapter 11 case of Borden Dairy Company, et al. (Case No. 20-10010, D. Del.), one of the largest dairy processors in the U.S.  Advised regarding recovery of claims, critical vendor issues, assumption/rejection of contracts and sale of debtors’ assets.
  • Represented multiple creditors, including large regional dairy cooperative, in the Chapter 11 case of Southern Foods Group, LLC, et al. (Dean Foods) (Case No. 19-36313, S.D. Tex.), the largest dairy processor in the U.S. at the time.  Advised regarding recovery of claims, critical vendor issues, assumption/rejection of contracts and plan confirmation and successfully defended creditors in multiple preference actions.
  • Represented investor members and secured lender of the debtors in the Chapter 11 case of The LaSalle Group, Inc., et al. (Case No. 19-31484, N.D. Tex.) (converted to Chapter 7), memory care facilities and its affiliates. Advised client regarding recovery of claims and liquidation of debtors.
