Blake Wilson

Blake Wilson is a shareholder in Winstead’s Construction Practice Group. Blake’s forte lies in navigating complex construction and business disputes, whether that be through mediation, litigation, or otherwise. Blake has extensive experience litigating matters in both state and federal court, as well as arbitration and administrative proceedings, and has achieved successful outcomes for clients at all stages of litigation, including early pre-trial stages and up through trial and appeal.

Blake’s experience includes representing both public and private entities in commercial construction and real estate disputes involving land and subdivision development, multi-family projects, government buildings and developments, high-rise commercial and condominium developments, hotels, and industrial warehouse and facilities projects. Blake has established himself as an accomplished litigator of a wide variety of claims and issues, including construction defects, schedule delay claims, payment and accounting issues, governmental compliance and public procurement concerns, employee injury investigations, and numerous other breach of contract and tort claims.

Representative Experience

• Represented public university in multi-party lawsuit seeking recovery for extensive design and construction defects involving student dormitory
• Defended general contractor against multi-million dollar construction defect claims involving construction of two public schools
• Represented general contractor in arbitration hearing in defense of subcontractor’s schedule delay claims
• Represented State of Texas’s electrical grid operator in hundreds of lawsuits related to Winter Storm Uri
• Obtained successful resolution of schedule delays claims on behalf of owner of private hotel project in Austin, Texas
• Secured dismissal of breach of contract and fraud claims against out-of-state corporate client (including individually named executives) on special appearance for lack of personal jurisdiction claims
• Represented private land developer in dispute with neighboring property owner over stormwater run-off issues
• Represented Texas county against general contractor’s request for equitable adjustment of contract regarding alleged schedule delays
