In this presentation, we will briefly discuss the emergence of public-private partnerships in Texas, and how these procurement models are being used by universities and local governments across the State of Texas. We will cover the underlying statutory framework for procuring P3s in Texas, as well as other Texas-specific legal considerations that both public-sector and private-sector clients must consider when transacting P3s, including sovereign immunity, constitutional restraints, and ad valorem tax exemption.
