Winstead University: Bitcoin and Blockchain - U.S. Regulatory Considerations

The presentation will begin with a quick overview of blockchain technology and cryptocurrency basics. Then we will examine the recent activities of several U.S. regulators in the space, with a particular focus on the Commodity Futures Trading Commission and the Securities and Exchange Commission. For instance, we will address the question of whether a cryptocurrency is a commodity and look at recent CFTC enforcement & guidance. We will also present the analysis for whether a token is a security, providing insights in to SEC enforcement and other securities law issues for tokens and other digital assets. The discussion will also briefly address lending transactions involving bitcoin and other cryptocurrencies as collateral.
This course has been approved for MCLE credit by the State Bar of Texas Committee on MCLE in the amount of 1 credit hour.
