Peter Nolan has represented local businesses, Fortune 500 companies, insurance companies and other regulated industries, and state governments in state, federal and bankruptcy courts and administrative hearings throughout the United States. The range of his representation has varied from rule and ratemaking hearings concerning regulated industries before administrative law judges to complex commercial and regulatory litigation in state and federal courts. His areas of concentration are government enforcement and regulatory actions, complex business litigation, and insurance regulatory and enforcement litigation and defense. He has even defended the Alamo.

Representative Experience

  • Business litigation: Contract disputes, defense of carriers in contractual, coverage and bad faith disputes, state and federal securities law claims, lender liability, debt restructuring and recovery in both state receiverships and bankruptcy court, copyright, trade secret and trademark litigation
  • Government enforcement and regulatory actions: Representation of clients from civil investigative demands issued by State Attorney General's Offices and regulatory agencies before the State Office of Administrative Hearings; more than 35 years of administrative hearings concentrating in the fields of insurance, Texas franchise and sales tax, healthcare and professional licenses; hearings include conflict resolution, ratemaking, rulemaking and disciplinary actions filed against regulated companies or individuals; more than 35 years of experience litigating government enforcement actions, as well as receiverships, antitrust, Medicaid fraud and deceptive trade practice, as well as appeals of administrative hearings in state and federal courts


  • Representation of healthcare providers in Medicaid fraud investigation by State of Texas
  • Representation of numerous companies in antitrust and deceptive trade practice actions brought by State of Texas
  • Representation of insurance companies in bad faith and breach of contract first part claims (property and casualty)
  • Representation of insurance companies before the Texas Department of Insurance in contested case hearings and litigation involving the Texas Department of Insurance at both the trial and appellate level
  • Outside counsel for complex litigation and regulatory matters for the Texas Life Accident Health and Hospital Insurance Guaranty Association
  • Representation of the Texas Workers Compensation Insurance Fund and Texas Workers Compensation Insurance Facility in litigation against insureds for premium fraud
  • Representation of insurance companies and debtors in bankruptcy court in bankruptcies caused by mass tort litigation (for instance, represented Dow Corning in litigation concerning approval of $3.2 billion in insurance settlements to pay for breast implant claims and hundreds of millions of dollars in claims by the United States for Medicare reimbursements.)
